How Long Does an Expungement Take in California?
Typically, an expungement in California takes about 90 to 120 days from the time your petition is filed, though some older cases and certain courts may take longer due to backlogs or additional processing requirements. The overall timeline can vary depending on factors such as how quickly court records can be retrieved, whether multiple cases or counties are involved, and if the court requires a hearing before making a decision. Delays can also occur if paperwork is incomplete, fines or restitution are still outstanding, probation terms haven’t been fully satisfied, or the prosecutor requests time to review or object.
Working with an attorney to ensure everything is filed correctly and supported with the right documentation can help keep the process moving as smoothly and quickly as possible.
